End User License Agreement

1. Grant of License

While your trial or subscription is active, Licensor grants you a non-exclusive, non-transferable license to install and use WhisperType on one active machine at a time, subject to the terms of this Agreement. When the trial or subscription ends, the software stops running.

2. Restrictions

You may not:

• reverse engineer, decompile, or disassemble the software;
• rent, lease, lend, sublicense, or redistribute the software;
• remove or alter any proprietary notices, labels, or marks on the software;
• use the software to build a competing product.

3. Ownership

WhisperType is licensed, not sold. Licensor retains all right, title, and interest in and to the software, including all intellectual property rights.

4. Privacy — audio never leaves the machine

WhisperType transcribes audio entirely on your local computer. No audio, transcribed text, or clipboard content is ever transmitted to Licensor or any third party as part of normal product use. Transcription models are downloaded once at first launch and cached locally. Two exceptions, both off by default: the OpenAI provider for AI Polish, and the "full" usage-statistics level. By default the app sends anonymous usage statistics (performance counters, no transcript text), as the Privacy Policy describes; you may turn them off in Settings.

Optional crash reporting: if you explicitly opt in during first-run setup, anonymous stack traces and non-personal diagnostic tags (operating system and its version, app version) may be sent to our error tracking service. Crash reports never contain audio, text content, or any information that could identify you personally. You may opt out at any time in Settings.

5. Automatic Updates

WhisperType periodically checks https://whispertype.ai for new releases and, on Windows, downloads them in the background and installs them when you restart or quit the app. On macOS it tells you an update is available and you install it yourself. The check requests a file from our server and sends no account or usage data.

6. Termination

This license is effective until terminated. Your rights under this license terminate automatically, without notice from Licensor, if you fail to comply with any of its terms. Upon termination you must cease all use of the software and destroy all copies.

7. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR OPERATE WITHOUT INTERRUPTION.

8. Limitation of Liability

IN NO EVENT SHALL LICENSOR OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT, ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Peru, without regard to its conflict of law principles.

10. Entire Agreement

This Agreement constitutes the entire agreement between you and Licensor regarding the software and supersedes all prior understandings.
